DESERT DAZE MUSIC FESTIVAL SERVICE PROVIDER / ARTIST CONTRACT – DETAILS & DEFINITION OF TERMS

 

DESERT DAZE MUSIC FESTIVAL

CONTRACT FOR SERVICES

This CONTRACT is made between the DESERT DAZE MUSIC FESTIVAL (hereafter called the PURCHASER or the FESTIVAL) and the SERVICE PROVIDER (hereafter called the PROVIDER or ARTIST). The PURCHASER contracts for the SERVICES of the PROVIDER as witnessed according to the following terms and conditions of the engagement:

AMENITIES:

A $20 cash buyout meal allowance plus one beverage ticket per each contracted performer. 

TRANSPORTATION:

No transportation is provided. Transportation to and from and during the contracted event is the responsibility of the Provider/Artist.

PRODUCTION INFO:

The Festival will provide the venue, performance stage, PA system, audio reproduction equipment as well as audio technicians, stage lighting and “back line” (microphones, mic stands, cables and monitors etc. as well as a full drum kit). The Artist may bring their own microphones if they prefer.

The Artist will provide all musical instruments, amplifiers and any other equipment they may require in order to fulfil the conditions of this contract.

The Artist may provide their own auxiliary equipment (mics). Artist must provide Purchaser with a stage plot (or stage configuration map) at least 2 weeks prior to the date of the event.

The Artist is asked to arrive on site of the performance no later than 30 minutes prior to their contracted event time for set-up and sound check.

PROMOTION:

The Artist will supply to the Purchaser with materials and resources that may be used by the Purchaser for the promotion and advertising of the contracted event. These materials shall include:

  • Recent photo(s) of the artist
  • A current bio of the artist
  • EPK if available

Links to online resources which contain useful information about the artist i.e., websites, social media platforms, YouTube or other videos, audio files etc.) Please provide these promotional resources in a separate email with attachments or links to specific materials.

The Purchaser also reserves the right to obtain material found in public or online platforms (with or without copyright) i.e., graphic elements, photographs, text, audio or videos, for use in print materials and/or digitally on the Purchasers website and social media pages, solely for the promotion and advertising of the contracted event.

The Artist hereby irrevocably grants the Purchaser the right to use the name of the Artist and other personnel participating in this initiative, as well as real-time video captures, images and other screenshots, illustrations and other publicity materials to publicly promote, publicize and advertise the contracted event.

LIABILITY WAIVER:

Neither the Purchaser nor any of their respective representatives, employees, volunteers, directors, agents, assigns, professional advisors, consultants or funders shall be liable for any direct, indirect, consequential or incidental loss or damage arising from this event, and the Providers/Artists agrees to (and does) fully indemnify any and all such parties from any such loss or damage.

The Providers/Artists acknowledge they are not employees of Desert Daze Music Festival nor of the Spences Bridge Community Club and are responsible for all applicable licenses, taxes, and insurance of a normal business. The Providers may be required to provide a status or clearance letter from Worksafe BC. The Providers/Artists agree to fully participate in all safety measures that either they or the Purchaser identify or become aware of during the event. Both parties acknowledge the other party is not liable for any direct, indirect, consequential or incidental loss or damage arising from this event.

Force Majeure: In no event shall the Purchaser be responsible or liable for any failure or delay in the performance of its obligations documented herein arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services; it being understood that the Purchaser shall use reasonable efforts which are consistent with accepted practices in the live music / festival industry to resume performance as soon as practicable under the circumstances.

COVID 19 HEALTH AND SAFETY PROTOCOLS:

Provision of all contracted services are at the Providers/Artists own risk and the Purchaser will not be held liable for any damages, injury or illnesses associated with the contracted service. Without limiting the generality of the foregoing and for further clarity Desert Daze Music Festival nor the Spences Bridge Community Club will be held responsible if someone acquires an illness or tests positive for the Coronavirus as a result of the provision of the contracted service.

The Purchaser agrees to produce the contracted event in accordance with the regulations of WorkSafe BC and the orders and recommendations of the BC Provincial Health Officer, including, without limitation, as they relate to the Novel Coronavirus (2019-nCoV) and the Covid-19 pandemic.

The Purchaser agrees to create and implement a Covid-19 Safety Plan specific to the production of the contracted event as (and if) required and mandated by the BC Provincial Health Officer and WorkSafe BC. This Safety Plan will be published and made available to all parties partaking in the FESTIVAL.

The Artist agrees to comply fully to all Policies and Guidelines as outlined in the Covid-19 Safety Plan.
